Pursuant to the Regulation of the European Parliament and of the Council (EU) 2016/679 dated 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), please be advised that:

Purposes of and legal basis for personal data processing

Your personal data will be processed by the employer for the purpose of performing a contract of employment or a civil law contract to which the data subject is a party, or to take, at the request of the data subject, actions necessary prior to the execution of the contract, on the basis of a legal obligation which the Controller is obliged to fulfil (Article 6 Section 1(c) of the GDPR), i.e.:

  • the performance of duties pursuing from the Labour Code laws and regulations, including the maintenance and archiving of personnel files;
  • the fulfilment of duties pursuing from legislation on social insurance, health insurance, taxes, accidents at work, company social benefit fund, accounting, general duty of defence and other obligations deriving from applicable laws and regulations;
  • the organisation and co-financing of additional benefits for employees and for the family members or partners of employees (e.g. group life insurance, health insurance);
  • making data available to entities authorised to receive such data by law and to entities to whom the data is necessary because the employee is exercising specific rights provided for in labour law,
  • notifying family members in the event the employee suffers an accident.

Information on personal data processing

Access to your personal data will be granted to authorised employees of the Personal Data Controller and entities providing services to the Controller. Personal data may be disclosed to recipients who will process the data on behalf of the Warsaw Observatory of Culture, and public administration bodies authorised to obtain the personal data in pursuance of generally applicable laws. The recipients of personal data will be institutions authorised by law and third parties, in particular: the Social Insurance Institution, tax authorities, courts, police, public prosecutor’s office, bailiffs, court enforcement officers, banks (payment of salaries), insurance companies (only with respect to persons holding insurance policies), occupational health and safety service providers.

Personal data retention period

Personal data are retained in accordance with the Uniform Material List of Files.

Rights pursuing from Articles 15 to 19 of the General Regulation of the European Parliament and of the Council (EU) 2016/679

In connection with the processing of personal data you have the following rights:

  • the right to access your data and to receive a copy of them;
  • the right to rectification (correction) of your data;
  • the right to the erasure of your personal data where the processing does not take place for the purposes of the performance of an obligation imposed by law or by way of official authority;
  • the right to restrict data processing;
  • the right to transfer your data;
  • where processing is based on consent, the right to withdraw the consent at any time.

Right to file a complaint

You have the right to file a complaint to the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, if you believe that the processing of your personal data by the Data Protection Officer violates the provisions of Regulation of the European Parliament and of the Council (EU) 2016/679.

Information on voluntary or obligatory provision of personal data

The provision of data is necessary for the execution of the contract and the fulfilment of the employers’ obligation to keep records in matters relating to the employment relationship and the manner in which the employee’s personal file is maintained. The provision of data concerning trade union membership, membership in a welfare fund, participation in group insurance, supplementary medical insurance, the granting of social benefits is voluntary.


Your personal data will not be processed by automated means, including profiling.
