Personal data protection notice regarding data processing for job applicants – Recruitment

Pursuant to the Regulation of the European Parliament and of the Council (EU) 2016/679 dated 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), please be advised that:

Purposes of personal data processing

Your personal data will be processed for the following purposes:

  • to carry out the recruitment process, on the basis of the employer’s entitlement under Article 22 of the Labour Code and with regard to: name, parents’ names, date of birth, place of residence, correspondence address, educational background and previous employment history. The basis for the processing of the above personal data is a legal obligation (Article 6 Section 1(c) of the GDPR);
  • to carry out the recruitment process, on the basis of your consent to the processing of your personal data, i.e. personal data other than those indicated in the point above, provided in your CV, form, cover letter and other documents. The basis for the processing is said consent (Article 6 Section 1(a) of the GDPR);
  • for future recruitment processes, on the basis of your consent to the processing of personal data provided in your CV, application form, cover letter and other documents. The basis for the processing is said consent (Article 6 Section 1(a) of the GDPR).

Information on personal data processing

Access to your personal data will be granted to authorised employees of the Personal Data Controller and entities providing services to the Controller. Personal data may be disclosed to recipients who will process the data on behalf of the Warsaw Observatory of Culture, and public administration bodies authorised to obtain the personal data in pursuance of generally applicable laws.

Personal data retention period

With respect to the purposes in Sections a, b, your data will be retained for the time necessary to carry out this recruitment process. With respect to the purposes in Section c, your personal data will be retained for a period of 12 months from the date you provide your consent.

Rights pursuing from Articles 15 to 19 of the General Regulation of the European Parliament and of the Council (EU) 2016/679

In connection with the processing of personal data you have the following rights: 

  • the right to access your data and to receive a copy of them;
  • the right to rectification (correction) of your data;
  • the right to the erasure of your personal data where the processing does not take place for the purposes of the performance of an obligation imposed by law or by way of official authority;
  • the right to restrict data processing;
  • the right to transfer your data;
  • where processing is based on consent, the right to withdraw the consent at any time.

Consent

You have the right to withdraw your consent to the processing of your personal data at any time, with respect to personal data processed on the basis of your consent to the processing of your personal data. The withdrawal of consent shall not affect the processing that took place prior to consent withdrawal.

Right to file a complaint

You have the right to file a complaint to the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, if you believe that the processing of your personal data by the Data Protection Officer violates the provisions of Regulation of the European Parliament and of the Council (EU) 2016/679.

Information on voluntary or obligatory provision of personal data

The provision of personal data including your name, date of birth, place of residence, education, and previous employment history is a condition for taking part in the respective recruitment process. In all other respects, the provision of personal data is voluntary.

Personal data will not be processed by automated means, including profiling.
